Summary of CM's submissions on the Charge / evidence Following a Match Review Panel meeting held on the 02 April 2013, you are charged with misconduct for 2 separate breaches of Law 15.1 (a) during the above Match. The case before the Tribunal tonight is the second alleged breach. The Panel reviewed an incident in the 47th minute of the match. You were dismissed by the Match Referee following this incident. In the Panel’s opinion when attempting to tackle you made contact with the head of a Catalans player (Bosc) with your upper arm/shoulder. The Panel deemed this contact to be reckless with the potential to cause your opponent injury. In accordance with the RFL’s On Field Sentencing Guidelines, the Panel consider that such an offence is a Grade B offence (Strikes with shoulder – Reckless). If found to have committed the offence, again in accordance with the On Field sentencing Guidelines, the normal suspension range for such an offence is from a 1 to a 2 match suspension. In addition the Tribunal has the power to impose such a fine as it considers reasonable.
Summary of Player's submissions on the Charge / evidence Head coach Brian McDermott representing the player pleads guilty to the offence on behalf of his player. Mr McDermott apologises for Mr Bailey’s absence due to medical reasons. The player does make contact with the player’s head Mr McDermott acknowledges. In the circumstances the opponent is known for stepping inside and it is almost a good technique tackle if he had wrapped his arms around however the player’s arm is raised Mr McDermott concedes and his feet have left the ground which you cannot do. These are merely mitigating circumstances as the player is guilty of the offence.

Reasons for Decision The committee have viewed this offence in its entirety. The committee give the player credit for pleading guilty but the committee feel this was a particularly bad tackle and the player’s feet have left the ground. The tackle had the potential for serious injury and coupled with the player’s poor disciplinary record, the committee feel that a 2 match suspension and a £300 fine is appropriate.
